       REGISTRATION OF MARRIAGES UNDER MUSLIM MARRIAGE & DIVORCE ACT (Chap.115)

 

  • Muslim marriages should be registered in accordance with the provisions under this Act.

 

 

  • At least one of the parties to the marriage should be a citizen of Sri Lanka.

 

  • A marriage contracted by a Muslim woman during her period of "Iddat" shall not be registered under the Act.

 

  • A marriage contracted by a Muslim girl who has not attained the age of 12 years shall not be registered.

 

 

 

 

  • Both parties should be of the Muslim faith.

Procedure for Registration

  • The marriage registration between concerned parties shall take place immediately upon the conclusion of the "Nikah" ceremony.
  • Date, time and place of the ceremony should be informed to the Diplomatic/Consular Officer by the following persons in order to register the marriage.
  1. The Bridegroom
  2. The Wali of the bride
  3. The person who conducts the Nikah ceremony
  • Before the registration of a marriage the following declaration should be made and signed in the presence of the concerned officer in the Embassy.
  1. Declaration by the Bridegroom - Annexure C
  2. Declaration by "Wali" of the bride - Annexure DD
  • After signing the declarations, officer concerned should enter the particulars of the marriage in triplicate in the marriage register.
  • The statement of particulars entered in the register in respect of each marriage is to be signed and attested by the following persons.
  1. The bridegroom
  2. The Wali of the bride
  3. The person who conduct Nikah ceremony
  4. The Diplomatic/consular Officer
  • The third Copy of the Marriage Entry shall be handed over to the female party by the Diplomatic Officer.
